Judgment
This Appeal is directed against the order dated 26.9.2003 passed by the learned Single Judge dismissing the Writ Application (C.W.J.C. No. 7160/2003) [being reported in this Issue at pg. 206] filed by the Petitioner challenging the order of acquisition of 2 decimals of land out of Plot No. 933 for laying down a road in Mushahari Anchal at the juncture of two villages namely, Manika Harikesh and Naya Gaon.
The question that was urged before the learned Single Judge has been reiterated before this Court. It is submitted that no notice was served upon the Appellant-Petitioner. In our view the learned Single Judge has rightly rejected the same as admittedly the Appellant had filed an objection which was only considered in the enquiry and the authorities came to the conclusion that the acquisition of the land has been made for construction of a road which will be beneficial to more than 100 persons. In our view this acquisition has been made in accordance with the provisions of the Land Acquisition Act.
There is no merit in this Appeal. The same is rejected.
