G.B. Patnaik, J.—The Petitioners have assailed the order of the learned Magistrate dated 28.4.1982 passed in Criminal Misc. Case No. 170 of 1981 directing the Petitioners to execute a bond of Rs. 1,000/- to keep peace for a period of six months. Against the said order the Petitioners preferred an appeal, but the learned Sessions Judge having dismissed the same, the Petitioners have approached this Court.

Mr. Ram, the learned Counsel for the Petitioners, raises several contentions challenging the original order as well as the appellate order, but it is not necessary to examine them as in my view the proceeding which was initiated in 1981 has become rather stale and after lapse of more than seven years, it would be a travesty of justice to direct the Petitioners to execute a bond as directed by the learned Magistrate. On this short ground, I would quash the order of the learned Magistrate directing the Petitioners to execute the bond question and quash the proceeding itself.

This criminal revision is accordingly allowed.
