The petitioners seek quashing of FIR No. 626 of 2015 under Sections 323/325/341/34 of the IPC registered at Police Station Keshav Puram, Delhi,

based on a settlement.

The parties are neighbours. The subject FIR was registered consequent to a quarrel that took place between the parties. As per the parties the

quarrel took place on the spur of the moment on a misunderstanding.

It is contended on behalf of the parties that parties have settled all their disputes with the intervention of respectable persons of the society, elders,

well-wishers and family members and a settlement agreement dated 14.05.2018 has been recorded before Delhi Govt. Mediation & Conciliation

Centre, Rohini, Delhi.

As per the settlement, a sum of Rs. One lakh was agreed to be paid to respondents in full and final settlement as also to compensate the injured for

the injuries sustained. A sum of Rs. 25,000/- has already been paid and the balance sum of Rs. 75,000/- is being paid by way of DD No. 802329 dated

14.05.2018 to respondent no. 2 today in Court.

Respondent no. 2 & 3 are present in court in person, represented by their counsel and are identified by the Investigating Officer. They acknowledge

that they have received the entire amount and settled with the petitioner. They further submits that they have settled the disputes with the petitioners

and are agreeable to the settlement and do not wish to press the criminal charges against the petitioners any further.

In view of the fact that the disputes between the petitioners and respondent no. 2 & 3 have been settled, continuation of criminal proceedings will

be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends

of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

In view of the above, the petition is allowed. FIR No. 626 of 2015 under Sections 323/325/341/34 of the IPC registered at Police Station Keshav

Puram, Delhi and the consequent proceedings therefrom are, accordingly quashed.
