This petition has been heard through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic. None of the parties have complained about any technical snag of audio-video and with their consent this matter has been heard.
I.A. No.179 of 2020 has been filed for impleading the Superintendent of Police, Giridih and the Officer in charge, Bagodar Police Station as respondent nos.4 and 5 in this petition.
The prayer made in the I.A is allowed and the I.A is disposed of.
The learned counsel for the petitioner shall array the Superintendent of Police, Giridih and the Officer in charge, Bagodar Police Station as respondent nos.4 and 5 in the cause title.
This petition has been filed for directing the respondent authorities to consider the representation of the petitioner company which is pending before the respondent nos.1 and 2 and other prayers made in the writ petition has not been pressed by the learned counsel appearing on behalf of the petitioner.
The learned counsel appearing on behalf of the petitioner submits that inspite of several representation filed by the petitioner before the police officers the representation has not been considered and no appropriate order has been passed.
The counter affidavit has been filed on behalf of the respondent State wherein it has been disclosed that the site in question are physically verified and the answering respondents vide Memo No.1660/2021 dated 30.11.2021 and the plot number etc. has been disclosed where the crusher in question has been established.
In view of the above facts and considering the submissions of the learned counsels appearing on behalf of the parties, without entering into the merits of the case, it is being disposed of with a direction to the petitioner to the petitioner to file a fresh representation before respondent no.4-Superintendent of Police, Giridih.
W.P.(Cr.)No.276 of 2021 is disposed of directing the respondent no.4 to pass a fresh order.
