Amidst the various assertions, allegations and averments made and urged in this writ petition, the limited plea made by Sri.Arun Samuel – learned counsel for the petitioner, is that his client's representation, namely Ext.P3, pending before the Secretary of the 4th respondent – 'Trivandrum Ayurveda College Co-operative Society Ltd.' ('Society', for short), be directed to be taken up and dispose of, after affording her an opportunity of being heard, without any avoidable delay.
The learned Government Pleader – Smt.Parvathy Kottol, submitted that, since the afore plea relates only to the representation pending before the Society, official respondents have no role to play as of now.
I notice that even though summons from this Court have been validly served on respondents 4 and 5, they have chosen not to be present in person or to be represented through counsel; thus inferentially guiding me to the impression that they have nothing to offer in answer to the allegations made in this writ petition.
In the afore circumstances, I deem it appropriate to accede to the afore limited request of the petitioner and to order this writ petition accordingly.
Resultantly, this writ petition is allowed to the limited extent of directing the Secretary of the 4th respondent – Society to take up Ext.P3 representation and dispose of the same, after affording the petitioner, as also any other person who may be affected or interested, an opportunity of being heard; thus culminating in an appropriate order and necessary action thereon, as expeditiously as is possible, but not later than one month from the date of receipt of a copy of this judgment.
