On 12-08-2021, this court issued notice to the sole respondent for which, appropriate step was taken by the learned counsel appearing for the
petitioner.
While issuing notice to the respondents, this court has passed an interim order directing that the Auction be deferred, if not already done, till the next
date by suspending the notice dated 18-07-2021.
When the matter is taken up for consideration, it has been submitted by Shri L. Gunindro, learned counsel that he has received instruction to appear on
behalf of the respondent although a copy of the writ petition has not been received by him. It has been submitted by him that the petitioner had already
approached this court by way of a writ petition being W.P. (C) No. 20 of 2020 and that the instant writ petition is not maintainable.
On 12-08-2021 itself, this court directed the petitioner to indicate the time period for onetime payment of the outstanding amount payable to the Bank.
Shri N. Surendrajit, learned counsel appearing for the petitioner submits that he has not yet received any instruction in this behalf and accordingly, a
weeks' time is granted to him for seeking instruction failing which, an endeavour shall be made to dispose of the matter on the next date itself.
List the matter on 03-09-2021. Interim order granted earlier by this court shall continue till the next date.
Copies of this order shall be sent to the counsels appearing for the parties through their WhatsApp/e-mail.
