Judgment

[1] Heard.
[2] The present petition has been filed under Article-226 of the Constitution of India for setting aside the impugned order dated 18.05.2023 and also revoke the impugned order dated 18.05.2023 and to record the names of the petitioners in the Khatian, in connection with their respective shares of the land in question and for directing them to dispose of the revision petition dated 17.10.2023 preferred by the petitioners before the Principal Secretary, Revenue Department, Government of Tripura, Agartala, West Tripura.
[3] The petitioners have prayed for the following reliefs:
“i. Issue rule, calling upon the official respondents and each one of them, to show cause as to why a writ of certiorari and/or in the nature thereof, shall not be issued, quashing/setting aside the impugned order dated 18.05.2023 (Annexure-9 supra).
ii. Issue rule, calling upon the official respondents and each one of them, to show cause as to why a writ of mandamus and/or in the nature thereof, shall not be issued, mandating/commending them, to forthwith revoke/rescind impugned order dated 18.05.2023 (Annexure-9 supra) and to record the names of the petitioners in the Khatian, in connection with their respective shares of the land in question, and for directing them to dispose of the revision petition dated 17.10.2023 (Annexure-10 supra) expeditiously, preferred by the petitioners, before the Principal Secretar4y, Revenue Department, Government of Tripura, Agartala, West Tripura within a specific time frame.
iii. Call for the records, appertaining to this writ petition.
iv. After hearing the parties, be pleased to make the rule absolute in terms of (i) & (ii) above.
v. Costs of and incidental to this proceeding.”
[4] The facts in brief are that the petitioners aggrieved by the order passed by the original authority preferred an appeal before the Revenue Secretary and the matter is pending since 2023. Since the matter would suffice if a direction is given directing the respondents, if at all any appeal filed by the petitioners is pending, the same be decided in accordance with law after giving opportunity to all concerned as expeditiously as possible. It is needless to observe that both sides shall cooperate with the quasi-judicial proceeding.
[5] As such, the present petition stands disposed of. As a sequel, miscellaneous application, pending if any, shall stands closed. Copy of this order be furnished to the learned counsel appearing for the parties as per procedure.
