Heard Sri.R.Radhakrishnan, applicant in person and Sri.V.A.Shaji, learned Additional Central Government Standing Counsel for the respondents.

Applicant had admittedly retired from service on 30.06.2023 as Joint Assistant Director from the office of the Directorate of Coordination (Police Wireless), Ministry of Home. He had drawn his last increment, prior to retirement, on 01.07.2022. Precise grievance of the applicant is that even though he had retired one year after accrual of the previous increment, was not given increment. Denial of the same was on account of his retirement on superannuation on 30.06.2023. Relying on various authorities including Director(Admn. and HR) KPTCL and others v. C.P.Mundinamani and others [AIR 2023 SC 1956] he submits that he is entitled to get additional increment on 01.07.2023.

Today, learned Standing Counsel has also brought to our notice copy of O.M.No.19/116/2024-Pers.Pol.(Pay) (Pt) dated 20.05.2025 which was issued pursuant to the decisions of the Hon'ble Supreme Court.

Admittedly, the applicant had retired from service on 30.06.2023. He had earned previous increment on 01.07.2022. Since he had rendered service for a full year after the accrual of the increment on 01.07.2022, he is entitled to get notional increment on 01.07.2023.

Now, the law stands settled as laid down by the Apex Court in Mundinamani, quoted supra, followed by the order of the Hon'ble Supreme Court in Union of India v M. Siddaraj [CA 3933 of 2023]. On the lines of the directions issued by the Apex Court the aforestated O.M. has been issued, which is applicable in the case on hand.

In the circumstances, the applicant falls in clause 3(a) of the O.M. The respondents are directed to pass orders granting him benefits including arrears within a period of three months from the date of receipt of a copy of this order.

The Original Application is allowed as above. No costs.
