Judgment

Cause shown is sufficient to allow the delay condonation application. Consequently, Delay condonation application (CLMA No. 7258 of 2020) is
allowed and the delay in filing the restoration application is condoned.
Reasons furnished in the affidavit filed in support of restoration application are sufficient to allow the restoration application. Accordingly,
restoration application (MCC No. 388 of 2020) is allowed and the order dated 12.03.2019 passed by this Court is recalled and the Writ Petition is
restored to its original number.
According to the petitioner, his land was taken for construction of National Highway No. 74, however, no compensation has been paid to him and
even proceedings for acquisition of land were not initiated.
According to the petitioner, he has made a representation to Special Land Acquisition Officer, Rudrapur, District Udham Singh Nagar on
19.12.2018; but, no decision has been taken thereupon so far.
Since petitioner has already made a representation, therefore, the writ petition is disposed of with a direction to Special Land Acquisition Officer,
Rudrapur, District Udham Singh Nagar to consider petitioner’s representation dated 19.12.2018 and take decision thereupon, as early as possible;
but, not later than eight weeks from the date of production of certified copy of this order.
Learned Deputy Advocate General undertakes to convey copy of this order to Special Land Acquisition Officer, Rudrapur, District Udham Singh
Nagar for compliance, within 48 hours.
Let a certified copy of this order be issued to learned Deputy Advocate General, free of cost, today itself.
