Heard on I.A. No.9126/2017, an application for condonation of delay. The application for grant of leave to appeal is barred by 753 days.

For the reasons assigned in the application, we are of the view that the cause shown is sufficient to condone the delay.

Accordingly, I.A. No.9126/2017 is allowed and the delay of 753 days in filing this appeal is hereby condoned.

Applicant /complainant has preferred this petition filed under Section 378(3) of Cr.P.C for grant of leave to appeal against the judgment dated

05/01/2015 passed by 14th Additional Sessions Judge, Indore in Sessions trial No.629/2010, whereby respondent No.3/accused-Shadab Khan has

been acquitted from the offence punishable under Sections 109, 365, 384, 467 and 468 of IPC and respondent Nos. 1&2/accusedRamzan and Shahil

have been acquitted from offence punishable under Sections 294, 452, 323/34, 506, 365, 384, 467 and 468 of IPC.

Brief facts of the case are that the applicant/complainant had purchased on plot No.708, of area 16/20 Sq.ft from Aliraj for a consideration of

Rs.22,000/-. On 25/09/2009 at about 5.00 pm, complainant Sahab Khan (P.W.3) was at his house, at that time, respondent Nos.1 &2/accused-

Ramzan and Shahil came there and they took complainant to the aforesaid plot by their motorcycle, where they hurled filthy language and asked

Sahab Khan (P.W.3) that how he is constructing the house on the aforesaid plot and they also assaulted him. Sahab Khan (P.W.3) explained that he

has purchased the plot from Aliraj and he is having notarised documents about the transfer of land and also showed the notary. Thereafter the

respondent No. 1 &2/accused persons took him to Court by motorcycle where they clicked got printed complainant's passport size photo and took him

to Office of advocate where they got executed one stamp paper from Sahab Khan (P.W.3) and threatened to kill him if he report anyone about the

incident. Applicant/complainant-Sahab Khan (P.W.3) lodged a report and on that basis, police registered F.I.R bearing Crime No.1077/2009 and

arrested accused persons. On the basis of disclosure statement of respondent No.2-Shahil Khan, police seized one agreement of sale and after

completion of investigation, charge-sheet was filed.

Learned trial Court, after due appreciation of the entire evidence on record, by impugned judgment acquitted the respondent Nos. 1 to 3/accused

from the aforesaid charges. Aggrieved by the judgment, applicant/complainant- has filed this petition for grant of leave to appeal against the

judgment of acquittal.

Heard learned counsel for the parties and perused the impugned judgment.

It is submitted by the learned counsel for the applicant/complainant that complainant-Sahab Khan (P.W.3) has categorically narrated the incident

which has been committed by the respondent Nos.1 to 3/accused and his statement has got further support by statement of Shahnaz Bi (P.W.4),

Paramathmasingh (P.W.6) and Dwarakaprasad (P.W.7), however, the learned trial Court has wrongly dis-believed the statement of the complainant

and the aforesaid witnesses and acquitted the respondent Nos.1 to 3/accused. Therefore the applicant/complainant has prayed for grant of leave to

appeal against the judgment of acquittal.

On the perusal of the statement of the complainant-Sahab Khan (P.W.3), it appears that he has gone to the photo studio for taking his photograph

and has also gone to Court and to the Office of Registrar with the respondents/accused persons on motorcycle and executed agreement of sale, but,

he had not made any cry against the act of the respondents and not made any complaint. He has also admitted that when he was going to the Court,

police was present on every square, however, he has not made any complaint to any police authority or notary or Registrar that respondent Nos. 1 to 3

/ accused persons took him forcefully. There are various inconsistency, omissions found in the statement of the complainant as well as the other

prosecution witnesses. 08. Looking to the aforesaid facts and circumstances, in our considered opinion, the findings recorded by the trial does nor

suffer from any illegality or perversity nor can be interfered by this Court. It is settled principles of law that if the trial Court, after due appreciation

of the evidence, came to the conclusion of the finding of acquittal and normally if the finding is not perverse, it should not be interfered by the appellate

Court. For this reliance can be placed on the decision of the Hon'ble Apex Court in the case of Muralidhar alias Gidda and Anr. v. State of

Karnataka (2014) 5 SCC 730, in which the Hon'ble Apex Court laid down the legal principles for entertaining the appeal against the acquittal and held

as under:

“12. The approach of the appellate court in the appeal against acquittal has been dealt with by this Court in Tulsiram Kanu, AIR 1954 SC 1, Madan

Mohan Singh AIR 1954 SC 637, Atley AIR 1955 SC 807, Aher Raja Khima AIR 1956 SC 217, Balbir Singh AIR 1957 SC 216, M.G. Agarwal AIR

2007 SC(Supp) 61) and Chandrappa(2007) 4 SCC 415: (AIR 2007 SC(Supp) 111). It is not necessary to deal with these cases individually. Suffice it

to say that this Court has consistently held that in dealing with appeals against acquittal, the appellate court must bear in mind the following:

(i) There is presumption of innocence in favour ofan accused person and such presumption is strengthened by the order of acquittal passed in his

favour by the trial court,

(ii) The accused person is entitled to the benefit ofreasonable doubt when it deals with the merit of the appeal against acquittal,

(iii) Though, the power of the appellate court inconsidering the appeals against acquittal are as extensive as its powers in appeals against convictions

but the appellate court is generally loath in disturbing the finding of fact recorded by the trial court. It is so because the trial court had an advantage of

seeing the demeanor of the witnesses. If the trial court takes a reasonable view of the facts of the case, interference by the appellate court with the

judgment of acquittal is not justified. Unless, the conclusions reached by the trial court are palpably wrong or based on erroneous view of the law or if

such conclusions are allowed to stand, they are likely to result in grave injustice, the reluctance on the part of the appellate court in interfering with

such conclusions is fully justified, and

(iv) Merely because the appellate court on reappreciation and re-evaluation of the evidence is inclined to take a different view, interference with the

judgment of acquittal is not justified if the view taken by the trial court is a possible view. The evenly balanced views of the evidence must not result in

the interference by the appellate court in the judgment of the trial court.â€​

In view of the re-appreciation of the entire evidence and on the basis of the legal principles laid down by the Hon'ble Apex Court, we are of the

considered view that the findings recorded by the trial Court does not appear to be perverse. Accordingly, no grounds are available for grant of

leave against the impugned judgment.

Resultantly, the petition filed on behalf of the applicant is dismissed accordingly.
