Judgment
With the consent of both parties, this Writ Petition is taken up for disposal at the stage of admission.
Heard Sri G.Ramakrishna, learned counsel for the petitioner and Ms. S. Sravanthi, learned Assistant Government Pleader for Stamps and Registration, appearing for the respondents.
Aggrieved by the action of respondent No.3 in refusing to receive and validate/impound the Sale Deed dated 13.07.2000 by collecting deficit stamp duty if any, executed by B.Rajeshwar & 4 others represented by their GPA Holder Sri Daniel Nelso in respect of the property to an extent of Ac.0-13 gts forming part of Sy.No.163, situated at Moosapet Village, Balanagar Mandal, Ranga Reddy District, the petitioner filed the present Writ Petition.
Learned counsel for the petitioner submits that the petitioner purchased the subject property by virtue of a Sale Deed dated 13.07.2000 for valuable consideration from one B.Rajeshwar & 4 others, represented by their GPA Holder Sri Daniel Nelson by virtue of a registered Sale Deed bearing Document No.691/1990 dated 06.03.1990 in favour of the said Daniel Nelson. Ever since the said purchase, the petitioner is exercising the ownership and possession over the subject property. It is further submitted that, in order to regularize the Sale Deed dated 13.07.2000, the petitioner approached respondent No.3 on 31.07.2026 along with the original Sale Deed and all relevant link documents for the purpose of impounding and validation under the provisions of the Indian Stamp Act, 1899, and expressed his willingness to pay the deficit stamp duty and penalty, if any. However, respondent No.3 refused to receive the same. It is also submitted that this Court, in similar circumstances, in W.P. No.5587 of 2025, by an order dated 25.02.2025, granted liberty to the petitioner therein to make a representation for impounding/validating the sale deed. Therefore, learned counsel prays this Court to pass a similar order in the present Writ Petition.
The above made submission is not seriously disputed by learned Assistant Government Pleader appearing for the respondents.
Having regard to the submissions made by learned counsel for the respective parties and without expressing any opinion on the merits of the case, this Writ Petition is disposed of granting liberty to the petitioner to submit a representation for impounding/validation of the Sale Deed dated 13.07.2000, within a period of one (1) week from the date of receipt of a copy of this order. Upon receipt of such a representation, the respondent authorities shall consider the same and pass appropriate orders, strictly in accordance with law, as expeditiously as possible, preferably within a period of four (4) weeks from the date of receipt of the petitioner's representation and shall communicate a copy of the decision to the petitioner.
Miscellaneous petitions, if any, pending shall stand closed. There shall be no order as to costs.
