The applicants were initially appointed as Primary Teachers in the Directorate of Education of Delhi. They were promoted to the post of Trained

Graduate Teacher (TGT) in November, 2010. Their grievance is that several teachers, junior to them in the post of Primary Teachers, were promoted

through order dated 03.03.2010, whereas the applicants were not promoted. Their claim is that they were also entitled to be promoted with effect from

the same date. They claim to have made representations ever since 2010 in this regard. This O.A. is filed with a prayer to direct the respondents to

grant seniority to the applicants in the cadre of TGT on par with their juniors, who were promoted on 03.03.2010.

We heard Sh. Ranjit Sharma, learned counsel for applicants and Ms. Esha Mazumdar, learned counsel for respondents, through video conferencing.

It is a matter of record that promotions to the post of TGT took place on 03.03.2010 on the basis of the recommendations made by the

Departmental Promotion Committee (DPC). The names of the applicants did not find place in the list of promotees. In case any Primary Teacher

junior to the applicants was promoted on 03.03.2010, it was expected of the applicants to raise objections and to pursue remedies. The applicants were

promoted in November, 2010. Naturally, they would figure junior to those, who were promoted 03.03.2010.

The claim made by the applicants at this stage cannot be considered for two reasons. Firstly, there is a delay of one decade in claiming the relief

and secondly, the persons, who would be affected in case the applicants are made seniors, are not made parties.

The O.A. is accordingly dismissed. It is, however, left open to the applicants to put forward their claim as and when steps are initiated for

preparation of the seniority list for the post of TGT, if the seniority list was not published as yet.

M.A. No.2080/2020 shall stand disposed of.

There shall be no order as to costs.
