The only defence raised by the respondents to oppose the claim of the petitioners, who were Ex-Servicemen, was that the Ex-Servicemen Corporation, Hamirpur, was not empaneled with the DGR, which was a condition precedent for participation in the tendering process for providing security and allied services in the premises of he respondent-Corporation (NTPC).

It is not in dispute that during the pendency of these petitions, the H.P. Ex-Servicemen Corporation has obtained the DGR empanelment and is now empaneled with the Government of India, Ministry of Defence, Directorate General of Re-settlement (DGR) for providing services of Ex-Servicemen vide empanelment certificate No. 2828 and the contract has been renewed for the period from 17.09.2019 to 16.09.2022 and now the status of the contracts awarded by NTPC Ltd. in favour of the Ex-Servicemen Corporation is as under:

"(a) Security services contract consisting of 48 ex-servicemen security personnel has been awarded to H.P. Ex-servicemen Corporation wef 01 Jul 2020 to 20 Jun 2022 vide NTPC Ltd, Koldam purchase order No. 4600061745-017-1015 dated 18 Jun 2020.(Copy of same is annexed as Annexure P- 14).

(b) Miscellaneous services (Secretarial Assistant, Office Assistant and Dak Riders) contract consisting of 30 ex-servicemen has been awarded to H.P. Ex-servicemen Corporation wef 01 October 2019 to 30 September 2020 vide NTPC Ltd, Koldam purchase order No.4600058896-017-1015 dated 11 Dec 2019 and further extension of the contract till 30 Sep 2021 is in progress. The copy of the same is annexed as Annexure P-15.

(c) Maintenance contract for IT server room at Koldam (VSAT operators) consisting of 02 ex-servicemen has been awarded to HP Ex-servicemen Corporation wef 02 Apr 2020 to 01 Oct 2020 to vide NTPC Ltd, Koldam purchase order No. 4600060740 dated 02 Apr 2020 and further extension of the contract is in progress. The copy of same is annexed as Annexure P-16."

On account of subsequent developments, the petitioners have been granted the relief as was prayed for by them in the instant petitions and accordingly the present petitions are disposed of as having been rendered infructuous with passage of time. All pending applications shall also stand disposed of.
