Judgment
Kanwaljit Singh Ahluwalia, J.—Present criminal writ petition has been filed under Article 226 of the Constitution of India praying that the petitioner be temporarily released on parole u/s 3(1)(b) of the Haryana Good Conduct Prisoners (Temporary Release) Act, 1988 to enable him to attend the marriage of his younger sister, which is scheduled to be held on 10th February, 2012.
Counsel for the petitioner has drawn my attention to para No. 3 of the petition, wherein it is stated that a request for release of the petitioner on parole along with the marriage card was submitted to the Superintendent, Central Jail, Ambala, but till today no decision has been taken thereupon by the authorities.
Issue notice of motion.
On the asking of Court, Mr. Amandeep Singh, Assistant Advocate General, Haryana accepts notice on behalf of the State. A copy of the petition has been supplied to him.
Counsel for the State, after going through the contents of the petition, submits that a conscious decision on the prayer made by the petitioner shall be taken by 8th February, 2012 and the decision so taken shall be communicated to the petitioner.
Counsel for the petitioner states that the present petition be disposed of in view of the statement made by counsel for the State.
Ordered accordingly.
A copy of this order, duly attested by the Bench Secretary of this Court, be handed over to counsel for the State for onward transmission and compliance.
