Judgment
Counsel for M/s A2Z Waste Management Company Ltd. submitted that the office of the company has been raided by the income tax Department and has also been sealed and, therefore, they are not in a position to provide facts and figures as has been sought by order dated 2nd April 2012. Be that as it may, we are passing this order after taking judicial note of the fact that in fact in Ranchi virtually no work has been done, so far as cleanness of the city is concerned and, therefore, we direct M/s A2Z Waste Management Company Ltd. to show its working on the next date by filing affidavit and by indicating that how much man power, it has engaged for the job assigned to the company. The company may also disclose that how many persons are continuing in the company for cleaning the city.
Learned counsel for the petitioners submitted that M/s Meinhardt Singapore India Pvt. Ltd. has already been blacklisted in another Public Interest Litigation and the Court has already ordered for taking steps for sanction and prosecution by the Vigilance Department, Government of Jharkhand. It is submitted that the Municipal Corporation has paid Rs. 15.24 Crore in last one and half months.
Learned counsel for the Municipal Corporation submitted that in view of the order dated 2nd April, 2012 they have served notice upon the said company and a copy of which is placed on record as Annexure-D to the Supplementary Counter Affidavit filed on behalf of the Municipal Corporation.
Nobody has put appearance on behalf of the said Company M/s Meinhardt Singapore India Pvt. Ltd.
Therefore, Office is directed to issue notice to the M/s Meinhardt Singapore India Pvt. Ltd., A-8, Sector-16, Noida, Uttar Pradesh-201301 by speed post alongwith a copy of the order dated 2nd April, 2012 as well as a copy of this order, so that the said company may give its stand and explain the situation about the cleanness of the city of Ranchi and about their credentials.
Put up this case on 25th June, 2012 alongwith W.P.(PIL) No. 735 of 2012. Let a copy of this order be given to the learned counsels for the parties.
