Sardara Singh Lambardar vs State of Punjab

Ram Chand Gupta, J.—The present petition filed u/s 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case FIR No. 82, dated 17.3.2012, under Sections 420, 465, 467, 468, 471, 120-B IPC, registered at Police Station Zirakpur, District SAS Nagar, Mohali. I have heard learned counsel for the petitioner and have gone through the whole record carefully, including the impugned order passed by learned Additional Sessions Judge, SAS Nagar (Mohali), vide which application filed on behalf of the petitioner for anticipatory bail was dismissed.

Brief allegations are that one Harinder Singh was owner of the property in dispute. Petitioner conspired with co-accused and got executed a forged power of attorney by producing some other person who impersonated real Harinder Singh. Forged power of attorney was signed by present petitioner as Lambardar of the village and he also identified the alleged impersonator. Hence, custodial interrogation of the petitioner-accused is necessary to know as to who was the person who impersonated Harinder Singh and facilitated creation of forged power of attorney on the basis of which subsequent sale deed was registered of the land belonging to Harinder Singh Hence, in view of these facts it is not such a case in which extraordinary relief of anticipatory bail should be granted to the petitioner-accused. Without expressing any opinion on the merits of the case, the present petition filed by petitioner-Sardara Singh Lambardar for grant of anticipatory bail is, hereby, dismissed being devoid of any merit.
