Gopal Krishan Vyas, J.—Heard learned counsel for the parties. It is submitted that although succession certificate has been issued in favour of the petitioner by the Addl. District Judge, Bhadra, District Hanumangarh vide judgment dt. 25.9.2012 but respondents are not releasing her retiral benefits being wife of late Om Prakash, therefore, respondents may be directed to release retiral benefits of late Om Prakash who was working as Head Constable in the First Battalion of RAC.

After hearing arguments of learned counsel for the petitioner and perusing the judgment dt. 25.9.2012 passed by Addl. District Judge, Bhadra, this writ petition is hereby disposed of with the direction to the respondents to decide the claim of the petitioner for grant of family pension and other retiral benefits while taking into consideration the order dt. 25.9.2012 passed by the Addl. District Judge whereby the petitioner and her two sons were declared successors of late Om Prakash who died while in service within a period of three months from today. The writ petition is disposed of in above terms.
