This is a petition under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case bearing FIR No. 633 dated 02.12.2019 under Sections 120-B/406/420 IPC, registered at Police Station, Ambala Cantt., District Ambala.

Learned counsel appearing for the petitioner has argued that complainant Suman Chopra was got introduced to the petitioner by one Poonam Gupta. However, said Poonam Gupta, is not named in the present FIR. It is further argued that the instant FIR has been registered as a result of the political interference as the petitioner herself along with her husband has invested the money.

It is further argued that no amount has been received by the petitioner directly or indirectly nor she is associated with the management of the Company and the complainant has received an amount of Rs. 5,73,486/- as per the FIR itself. As per the petitioner, the main person is Harwinder Singh @ Goldy Bajwa, who has absconded with the entire money and the petitioner does not owe any money to the complainant.

Learned State Counsel assisted by the learned counsel for the complainant, has argued that other than the present FIR, 17 more complaints have been received from different ladies against the petitioner and an amount of Rs. 1.53 crore in all, has been siphoned off by the petitioner and other co-accused and specific allegations regarding handing over the cheques to the petitioner by the complainant have been made in the FIR. Not only this, the petitioner had supplied fake IDs to the complainant, which can be seen on the websites www.truckmoney.biz and www.truckmoney.in. It is further argued that the complainant had advanced the money to the petitioner after pledging gold with Muthoot Big Gold Loan Pledge from Muthoot Fincrop Ltd., Ambala Cantonment.

The petitioner has been specifically named in the FIR regarding her role accepting the money from the complainant and providing 16 fake IDs to the complainant through her own mobile phone. They money has been transferred by the complainant through banks and the petitioner along with co-accused Harvinder Singh Bajwa, has issued four cheques under her signatures and one cheque amounting to Rs. 4 lacs, has got dishonoured.

As the allegations leveled against the petitioner are serious economic offences thereby defrauding the innocent customers by alluring them to invest their money by providing false details and fake IDs on the websites, I do not find any ground to grant the concession of anticipatory bail to the petitioner.

Hence, the present petition is dismissed.
