Judgment

1) In this writ petition, petitioners are claiming for an appropriate direction to the respondents for considering their claim for appointment as Atithi Shikshak in terms of the order of the State Government dated 02.08.2019 and 14.06.2019.
2) The contention of the petitioners is that all the petitioners herein have worked as Vidya Mitaans during the period from 2016 till 2019. However, thereafter their services have been discontinued. According to the petitioners, similarly placed persons earlier had filed writ petition [WPS No. 7811 of 2019], which was disposed of vide order dated 01.10.2019 whereby this Court taking into consideration clause-1 of the said circular of the State Government dated 02.08.2019, directed the authorities to consider and decide the claim of petitioners in terms of the circulars of the State Government.
3) Considering the facts of the present case, this Court is inclined to pass an order to the extent that petitioners’ case may be considered by respondents No. 2 and 4 for being appointed as Atithi Shikshak if posts are lying vacant ; they fulfill minimum eligibility criteria and posts are not filled with regular appointments.
4) Let a decision be taken by the respondents No. 2 and 4 in respect of the petitioners at earlier preferably within a period of 60 days from the date of receipt of copy of this order.
5) In addition to their claim, petitioner would also be at liberty to file separate representations before respondents No. 2 and 4, who may consider the claims of petitioner for any recruitment to be made for the next academic session unless the circular stands modifed or amended.
6) It is made clear that this Court has not expressed any opinion on the merits of the case.
7) Accordingly, this petition stands disposed of.
