In this petition u/s 482 of the Code of Criminal Procedure, the defacto complainants in C.C.No.231/2009 on the file of the Judicial Magistrate of the First Class-I, North Paravur for offences under Sections 447, 427, 323 and 324 read with 34 IPC seeks an order to direct the Judicial Magistrate of First Class-I, North Paravur, before whom the case is pending, to have an earlier disposal of the case. It is reported by the learned Magistrate that the pendency before him till the year 2008 is 1669 and therefore the Magistrate is not in a position to report the time frame within which he could dispose of the case. Having heard I find that the petitioners are senior citizens and the 2nd petitioner is aged 72 years. Therefore, they are entitled to priority in disposal of the case.

In the result, this petition is allowed. There would be a direction to the Judicial Magistrate of the First Class-I, North Paravur to dispose of C.C.No.231/2009 as expeditiously as possible, at any rate, within nine months form the date of receipt of a copy of this order which the petitioner shall produce before the trial court.
