By way of present contempt petition, prayer has been made on behalf of the petitioners for initiation of contempt proceedings against the respondents for having willfully and intentionally disobeyed the judgment dated 9.11.2016, passed by the Erstwhile HP State Administrative Tribunal in OA No. 5557 of 2016, whereby tribunal below having taken note of the claim of the applicants that their case is squarely covered by the judgment dated 13.12.2012, rendered by this Court in LPA No. 105 of 2010, directed the respondents-Authority to consider the case of the petitioners strictly in light of aforesaid judgment and grant similar benefit, in case petitioners are found similarly situate within a period of three months from the date of production of certified copy of the order.
Careful perusal of reply(s) having been filed by the respondents clearly reveals that representations having been made by the applicants in terms of aforesaid judgment passed by the Tribunal have been duly considered and rejected vide order dated 21.8.2017 (Annexure R-1). Since representations having been filed by the petitioners in terms of judgment alleged to have been violated have been duly considered and decided by the respondents by way of speaking order dated 21.8.2017, learned Additional Advocate General is right in contending that judgment in question stands duly complied with.
Consequently, in view of the above, nothing remains to be adjudicated in the instant proceedings and accordingly, same are closed. However, liberty is reserved to the petitioners to file appropriate proceedings in appropriate court of law if they are still aggrieved. Notices issued to respondents are discharged at this stage.
