Satya Prakash @ Satya Kumar vs U.P.State Electricity Board and Others

A. P. Singh, J.—By means of the impugned judgment dated 2121994 the learned Single Judge has dismissed the writ petition by which the petitioner had prayed for his appointment in U. P. State Electricity Board by providing him benefit under Dying in Harness Rules on compassionate ground. U appears that the age of the petitioner when his father died was only four years and it was after about 15 years when he applied for employment on compassionate ground. Learned Single Judge has dealt with the question and having relied upon the judgment of Hon''ble Supreme Court in Umesh Kumar Nagpal v. State of Haryana reported in JT 1994 (3) SG 525 and Life Insurance Corporation of India v. Miss Asha Ramchandra Ambedkar, reported In JT 1994 (2) SC 183 has held that the petitioner was not entitled to the benefit of Dying in Harness Rules. We find no illegality in the order passed by the learned Single Judge.

There is no merit in the appeal which is accordingly dismissed.
