It is submitted by learned counsel for the petitioner that the issue raised in the present writ petition is squarely covered by order in Kailash Kumar v. State of Rajasthan & Ors.: S.B. Civil

Writ Petition No.2505/2022 & other connected matters, decided on 23.2.2022 and, therefore, the present petition may also be allowed in terms of the said order.

The respondents are not in a position to dispute that the issue raised in the present petition is squarely covered by order in the case of Kailash Kumar (supra).

In the case of Kailash Kumar (supra), this Court inter alia directed as under:-

“In view of the above discussion, the writ petitions filed by the petitioners are allowed. The respondents are directed to take into consideration the candidature of the petitioners based on their OBC (NCL)/ MBC certificates (Annex.2) along with affidavit filed by them and in case, they are found otherwise eligible and fall in merit, to include their names in the final select list / final merit list to be issued by the respondents.”

In view of the above, the writ petition filed by the petitioner is allowed in terms of and with similar directions as given in the case of Kailash Kumar (supra).
