S.C. Agarwal, J.—Heard learned counsel for the applicants and learned AGA for the State.

Learned counsel for the applicants submitted that it is a matrimonial dispute and an effort be made for reconciliation between the parties.

I agree with the submission advanced by learned counsel for the applicants. The matter is referred to Mediation Centre of this Court for mediation between the parties.

The applicants are directed to deposit a sum of Rs.10,000/ in the Office of the Registrar, Mediation and Conciliation Centre of this Court within three weeks from today. After deposit of money, the notice shall be sent to opposite party no.2 and his daughter Smt. Bharti by the Mediation Centre, which shall submit its report within three months.

On the first appearance of Smt. Bharti daughter of opposite party no.2 before the Mediation Centre, a sum of Rs.7000/ shall be paid to her out of the amount deposited in the Office of the Registrar, Mediation and Conciliation Centre, to defray her expenses for coming to Allahabad for the purpose of mediation. The remaining amount of Rs.3,000/ shall be utilized by the Mediation Centre as its expenses.

List after receipt of report of Mediation Centre before the appropriate Court.

Till the next date of listing, no coercive steps shall be taken against the applicants in complaint case no. 5 of 2011, under Sections 498A, 323 IPC, P.S. Khandauli, District Agra pending in the Court of Judicial Magistrate Ist, Agra.

If the amount of Rs.10000/, as ordered above, is not deposited by the applicants within the aforesaid period, the stay order shall automatically come to an end and the Office shall immediately list this case for further orders of this Court.
