Nawab Singh, J.—This order shall dispose of above mentioned two petitions because in both the petitions, quashing of First Information (for short ''FIR) No. 64 dated April 10th, 2002, registered under Sections 323, 324, 325 read with Section 34 of the Indian Penal Code (for short ''IPC'') at Police Station Banga Nawanshahr, is sought

By order dated April 08th, 2011, Ritu Bahri, J. directed the parties to appear before the trial Court and the trial Court was directed to record the statements of the parties. In compliance with the same, Judicial Magistrate Ist Class, SBS Nagar recorded the statements of the parties, whereby, they stated that they have compromised the matter. Compromise-deed (Annexure P3) has also been placed on record. In the circumstances, there cannot be any embargo in allowing the parties to compromise the matter in view of the law laid down by the Five Judge Bench''s decision of this Court rendered in Kulwinder Singh & others Vs. State of Punjab and another, 2007 (3) RCR (Criminal) 1052.

In view of above, petition is accepted. Consequently, FIR No.64 dated April 10th, 2002, registered under Sections 323, 324, 325 read with Section 34 IPC at Police Station Banga Nawanshahr and subsequent proceedings arising therefrom, are hereby quashed.
