Petitioner has filed this present writ petition seeking a direction to respondent to transfer her on request at an accessible place (sugam place) as per the option given by her in her application dated 12.05.2025, annexure no.6 to the writ petition.

It is contended by learned counsel for the petitioner that she is a widow having two minor children and handicap father-in-law.

Under the provision The Uttarakhand Annual Transfer for Public Servants Act, 2017 (Act No. 1 of 2018), under Section 13(6) of the said Act a widow (single parent) shall be eligible to request for transfer to areas of her choice.

The petitioner is presently posted as Pharmacist at State Allopathic Dispensary, Bansuli, Sera Almora which is situated at a distance of more than 300 kilometer from Dehradun-the native place of the petitioner. Due to her stay at Bansuli, Sera Almora there is immense problem in the family of the petitioner, therefore, she made a representation requesting respondent no.2-Director, Ayurvedic and Unani Services, Dehradun, to transfer her to an accessible place (sugam place) mentioned in the said representation/option letter. The said representation is still pending.

An innocuous prayer has been made by the petitioner for a direction to respondent no.2 to decide her representation expeditiously.

The prayer so made by learned counsel for the petitioner has not been opposed by learned State counsel.

Accordingly writ petition is finally disposed of and it is provided that respondent no.2-Director, Ayurvedic and Unani Services, Dehradun, shall decide the representation of the petitioner dated 12.05.2025, annexure no.6 to the writ petition, sympathetically, within a period of six weeks' from the date of production of certified copy of this order, if not already decided and to transfer her one of the places mentioned in her options given in option-letter.
