Shivam Balmik & Anr. vs State Of M.P. & Ors

This petition under Article 226 of the Constitution of India has been filed seeking protection in the light of the judgment passed by the Supreme Court in the case of Lata Singh Vs. State of UP, reported in (2006) 5 SCC 475 on the ground that the petitioners have married on 11.6.2020 in Arya Samaj Sanstha and a certificate to that effect has also been issued which is Annexure P/3.

It is submitted by the counsel for the petitioner that in fact the parents of the petitioner No.2 are extending threat to the life of the petitioner No.1, therefore, this petition has been filed.

In support of the contention of the petitioners, they have relied upon the application sent by them to the Senior Superintendent of Police, Bharatpur (Rajasthan) as well as to SHO, Police Station Ujjain, District Bharatpur (Rajasthan) which are Annexure P/5 and P/6 respectively.

Their representation made to the Senior Superintendent of Police, Bharatpur reads as under:-

महोदय,

उपरोक्त विषय में निवेदन है कि मैं प्रार्थिनी पूर्ण रूप से बालिग होकर अपना भला बुरा सोचने समझने में पूर्ण रूप से सक्षम हॅू तथा 18 वर्ष की आयु पूर्ण कर चुकी हूँ, तथा अपने भविष्य में निर्णय लेने के लिए पूर्ण रूप से स्वस्थ हूँ ।

यहकि, मुझ प्रार्थिनी के द्वारा अपना विवाह शिवम् बाल्मीक पुत्र श्री गंगादास बाल्मीक, निवासी-पम्प नम्बर-07, गणेशपुरा जिला मुरैना म0प्र0 के साथ दिनांक 11/06/2020 को आर्य वैदिक समाज संस्थान, खिड़की मोहल्ला ग्वालियर म0प्र0 में अपना विवाह सम्पन्न कर लिया है, अब मै अपने पति की विवाहिता पत्नी हूँ तथा मैं अपने पति के साथ निवास करना चाहती हूँ

यहकि, मुझ प्रार्थिनी को भय है कि मेरे माता-पिता व रिश्तेदारों के द्वारा मुझ प्रार्थिनी व मेरे पति तथा उनके परिवारीजनों के विरूद्ध कोई भी गुमशुदा या भगाकर ले जाने का झूठा प्रकरण दर्ज करवा सकते हैं, यदि ऐसा किया जाता है तो पहले मुझ प्रार्थिनी के कथन कराये जाये उसके पश्चात् ही कोई कार्यवाही की जाये।

अतः श्रीमान जी से निवेदन है कि मुझ प्रार्थिनी के द्वारा श्रीमान् को अपने विवाह की सूचना दी जा रही है, तथा मै अपने पति के साथ निवास करना चाहती हूँ तथा मेरे माता-पिता व रिश्तेदारों के द्वारा कोई भी झूठी शिकायत की जाती है तो पहले मेरे बयान/कथन दर्ज कराये जाये उसके पश्चात ही कोई कार्यवाही की जाये तो श्रीमान की अतिकृपा होगी।

Thus the petitioners have prayed that in case if any FIR is lodged, then the police before proceeding further, should record the statement of the petitioner No.2. The petitioner has not filed any document to indicate that they have ever made any complaint to police authority pointing out any threat extended by the parents of the petitioner No.2. Even the details of so called threat has not been mentioned in the writ petition. Thus it appears that the allegations of threat by the parents of the petitioner No.2 are nothing but self imaginary allegations. In fact, by sending the above mentioned applications, the petitioners had sought a relief from the Senior Superintendent of Police, Bharatpur (Rajasthan) that before registering the offence, the statement of the petitioner No.2 should be recorded. The Senior Superintendent of Police, Bharatpur (Rajasthan) does not fall within the territorial jurisdiction of this Court.

Accordingly, this petition is dismissed with liberty to the petitioners that in case if they so desire then they can file a writ petition before the High Court of Rajasthan.

With aforesaid liberty, the petition is finally disposed of.
