Judgment
Heard Mr. Tejesh Dande for the Petitioners and Ms. Dhruti Kapadia for Respondent Nos.1 to 3.
Mr. Dande, on instructions, states that the relief in terms of prayer clause (b) of this petition is already worked out, and the Petitioners have no further grievance in that regard. Ms. Kapadia also places on record the Panchanama under the cover of a letter dated 24 October 2024 to submit that the Petitioners' grievance under prayer clause (b) stands redressed.
Mr. Dande points out that the Petitioners applied for mutation on 19 November 2018, and the application has not been disposed of to date. He therefore requests that directions be issued to the mutation authorities to dispose of this application within a time-bound period.
Ms. Kapadia states that the Petitioners’ application dated 19 November 2018 will be disposed of within three months of today, following the law and principles of natural justice.
Accordingly, we accept the above statement and direct the concerned mutation authorities to dispose of the Petitioners’ application dated 19 November 2018 by following the law and granting reasonable opportunity to all the parties. All parties contentions are left open because we have not examined the matter on merits.
Mr. Dande points out that private Respondent Nos.7 to 20 have not been served to date. However, now that the relief in terms of prayer clause (b) has already been worked out and we have merely issued directions to the mutation authorities to dispose of the Petitioners’ application in accordance with the law, which includes the opportunity to hear all parties, we condone the non-service.
This Petition is disposed of in the above terms without any cost order.
