Vikramajit Sen, J.—On 15.10.2001 no appearance was put in on behalf of the Petitioner. On earlier dates for hearing counsel for the parties had jointly stated that the questions raised in this Writ Petition were receiving the attention of the Hon''ble Supreme Court. The case was adjourned from time to time for this reason. On 17.5.2000 counsel for the Petitioner had stated that the decision of the Hon''ble Supreme Court, which had been pronounced by them, was distinguishable. Mr. Vineet Bhagat, Advocate who was filed this writ petition had also filed another similar matter entitled Mr. Sarabjit Singh Sahi v. Union of India and Anr., CWP No. 4423/1999. Sahi''s Writ Petition was dismissed by my detailed Order dated October 18, 2001, in which the Apex Court''s decision was followed and applied.

The present writ petition stands on all fours with CWP 4423/1999. Perhaps it is for this reason that Mr. Vineet Bhagat, advocate has not put in appearance in this case.

The Petition is without merit and is dismissed.
