Shri Sharda Nand vs State of Himachal Pradesh, The Director Elementary Education, H.P., Shimla and Block Elementary Education Officer, Sadar-II Katola, Tehsil Sadar, District Mandi, H.P.

Justice Kurian Joseph, C.J.—The writ petition is filed with the following prayer:-

i) That the respondent may very kindly be directed to grant revised pay scale of Rs. 4550-7220/- to the petitioner since his initial appointment till regularization.

ii) That the respondents may kindly be directed to pay the whole amount of vacation salary for the entire service period rendered by the petitioner on contract basis with interest till its realization in view of the judgment passed by the Hon''ble High Court in CWP No. 415 of 2000.

As far as the entitlement of the petitioner for revised pay scale is concerned, the parties shall be governed by the decision of this Court in LPA No. 105 of 2010, subject to its finality.

As far as the issue regarding payment of vacation salary to contract teachers is concerned, the same is squarely covered in favour of the petitioner by the judgment of this Court rendered in CWP No. 415 of 2000, titled Baldev Singh and others vs. State of Himachal Pradesh and others and the judgment has become final. Therefore, there will be a direction to the respondents to release the due and admissible vacation salary, during the entire service period, to the petitioner in case the same has not been granted so far, within a period of four months from the date of production of a copy of this judgment along with a copy of the writ petition and the copy of the judgment, referred to above. If the amounts are not disbursed as above, the petitioner will be entitled to interest @ 10% and the officers responsible for the delay shall be personally liable for the same. The writ petition is disposed of, as above, so also the pending application(s), if any.
