This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been
arrested on 17.03.2018 in connection with Crime No.199/2016 registered at Police Station Jaijaipur, District - Janjgir - Champa (CG) for the offence
punishable under Sections 409, 420, 467, 468, 471 & 34 IPC.
As per the prosecution case, a report was made by Firatram Murar that the present applicant in connivance with the bank Manager got his name
recorded in the bank account of the complainant as a joint account holder and thereafter withdrew an amount of Rs.3,58000/- from the account of the
complainant. Thereby the offence has been committed.
Learned counsel for the applicant submits that the applicant is in jail since 17.03.2018 and the offences are triable by JMFC. He further submits that
the other co-accused persons have been enlarged on anticipatory bail by this Bench and the Co-ordinate Bench, therefore, the applicant may also be
released on bail.
Per contra, learned State counsel opposes the prayer for grant of bail.
Perused the case-diary documents. Considering the same and the facts & circumstances and the nature of allegations and also taking into that the
applicant is in jail since 17.03.2018, I am inclined to release the applicant on bail.
Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.25,000/-
with one surety in the like sum to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the
said Court.
