Judgment
Accused in Special Case No. 1002/2026, pending before the Court of Additional City Civil and Sessions Judge and FTSC-1, Bengaluru, arising out of Crime No.115/2026, registered by Marathahalli Police Station, Bengaluru, for offences punishable under Sections 8, 9(n),10 and 12 of POCSO Act 2012, is before this Court, in this petition, filed under Section 483 of BNSS, 2023, seeking regular bail.
Heard the learned counsel for the petitioner and learned Additional State Public Prosecutor on behalf of the respondent No.1 - State. Respondent No.2 is served in the matter and has remained unrepresented before this Court.
FIR in Crime No.115/2026 was registered by Marathahalli Police Station, for the aforesaid offences against the petitioner herein, based on the first information dated 21.03.2026 received from respondent No.2, who is the father of the alleged victim girl aged 17 years. During the course of investigation, petitioner was arrested on 21.03.2026 and remanded to judicial custody.
In the first information, it is alleged that, brother of the first informant had informed him on 20.03.2026 that, at about 04.40 p.m. on the said day, the petitioner had inappropriately touched the private parts of the victim girl while she was playing outside her house. It is under these circumstances, FIR was registered against the petitioner for the aforesaid offences. Investigation of the case is now completed and charge sheet is filed. Maximum punishment for alleged offences is, imprisonment for a period of 5 years. It is not in dispute that, petitioner has no other criminal antecedents. He has undertaken to abide by the conditions that may be imposed on him. Under the circumstances, the following:
ORDER
The petition is allowed.
The petitioner is directed to be enlarged on bail in Crime No. 115/2026, registered by Marathahalli Police Station, Bengaluru, for offences punishable under Sections 8, 9(n),10 and 12 of POCSO Act 2012, subject to the following conditions:
Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties (out of which, one local surety), for the likesum, to the satisfaction of the jurisdictional Court;
The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
The petitioner shall not involve in similar offences in future;
