Judgment
Hon''ble Sudhanshu Dhulia, J.—Heard Mr. Vikas Pande, Advocate present for the petitioner and Mr. N.P. Sah, learned Standing Counsel for the State of Uttarakhand.
The case of the petitioner is that while she was working as Assistant Teacher L.T. Grade, she appeared in an examination conducted by State Public Service Commission and was appointed to the post of Lecturer. While she was working as Assistant Teacher (General Studies) in Government Intermediate College, Kapkote, district Bageshwar and also teaching Political Science as the post of Lecturer (Political Science) was vacant since 2008, her choice was that she may be appointed as Lecturer in the same college or nearby college where the vacancy existed. All the same, the petitioner was posted in Government Intermediate College, Sainj, district Bageshwar. According to the petitioner such posting have to be given on the basis of the priority given by a candidate and in her case this has not been done. All the same, the petitioner has already moved a representation on 17.6.2011 for the said purpose before respondent no. 3 (Annexure-5 to the writ petition), which is still pending.
Mr. N.P. Sah, learned Standing Counsel for the State fairly submitted that with the consent of the parties the matter may be disposed of at the admission stage.
As such, the Director, School Education Uttarakhand, Dehradun (respondent no. 3) is directed to decide the pending representation of the petitioner (Annexure-5 to the writ petition) as expeditiously as possible. If the provisions of law presently applicable in the matter so permit and there exists any vacancy in the nearby place in Government Intermediate College or the same college at Bageshwar, the said authority may also consider posting of petitioner to the said college.
With the aforesaid direction, the writ petition is disposed of.
No order as to costs.
