6 paragraphs · 234 wordsJustice Kurian Joseph, C.J.—The writ petition is filed with the following prayers:
(i) That the late husband of petitioner Sh. Pritam Singh may be held entitled to the benefit of higher pay scale of Rs. 15800-21100 on completion of 16 years of service as Assistant Engineer/Assistant Executive Engineer/Executive Engineer after ignoring the impugned note, which has been struck down by this Hon�ble Court vide judgment dated 23.12.2009 and also given the similar treatment as given to the petitioners in CWP No. 5984 of 2011 vide judgment dated 29.7.2011, Annexure P-1;
(ii) That the respondent Board may be directed to revise the pay fixation/pension fixation of petitioner as a result of admissibility of the pay scale of Rs. 15800-21100 w.e.f. 1.1.1996, with further revision w.e.f. 1.1.2006, on completion of 16 years of service, with all consequential benefits.
It is for the petitioner to make appropriate representation before the first respondent, producing a copy of the judgment in CWP(T) No. 34 of 2008. In the event of the petitioner filing representation, the same shall be considered by the respondent and appropriate action in accordance with law without discriminating the petitioner shall be taken thereafter within two weeks. In case, the petitioner is found eligible for any benefit, the same shall be disbursed to the petitioner within another one month.
The writ petition is disposed of, so also the pending application(s), if any.
