Judgment
Kurian Joseph, C.J.—The petitioner has filed the present petition with the following prayer:
7.(i) That the denial of appointment as Arts and Craft Teacher (DM) on the basis of interview held on 24.04.1999 is bad, illegal, discriminatory and suitable directions be issued to the respondents to appoint the applicant as Arts and Craft Teacher (DM).
In the reply at para-3, it is stated as follows:
That the applicant has no cause of action to file the present original application before this Hon''ble Tribunal, since the office order issued by the respondent No. 4 is legal valid and according to the Rules of the respondents. The applicant can not allege that her juniors have been offered appointment, because the appointments issued by the respondent are only for the candidates having qualification of Art & Craft teacher from the recognized institution. The applicant has named one Smt. Sudesh Sharma, having passed same diploma from the same institution, which seems to be incorrect. The applicant should have impleaded Smt. Sudesh Sharma as respondent in the present O.A. so that the factual position could be ascertained. However, it is submitted that the concerned District Education Officer, is being asked to submit the factual report regarding appointment of Smt. Sudesh Sharma. In case her diploma will be found not recognized an action as per rules will be taken.
In view of the stand taken in the reply and in case the petitioner has still any grievance let, he may approach the first respondent.
The writ petition stands disposed of, so also the pending application(s), if any.
