This petition has been filed by the petitioners, who are husband and wife and are working as Multi-Purpose Workers in Sub Health Centre, Jhamta, Community Health Centre-Bichhua District-Chhindwara. By the impugned order Annexure-P2 dated 6.8.2012, both petitioners (husband and wife) have been transferred out of the District i.e. from District-Chhindwara to District Seoni and challenge to the order of transfer is made mainly on the ground that within a short period of less than 24 days, petitioners are being transferred again. Further contending that the transfer of the petitioner out of the district will cause serious inconveniences to them, challenge is made to the order of transfer.
Learned counsel for the petitioners invites my attention to the order passed on 13.7.2012 transferring the petitioners from one Centre to another in the same District-Chhindwara and now transfer is made out of Chhindwara.
Shri Rajesh Tiwari, learned counsel for the respondents submits that the earlier transfer was only a local adjustment from one Primary Health Centre to another and now on administrative consideration, petitioners are being transferred to District-Seoni.
Having heard learned counsel for the parties, it is seen that the transfer in question is challenged only on the ground of personal inconveniences of the petitioners. As far as question of frequent transfers is concerned, it is seen that the earlier transfer order dated 13.7.2012 was only a local order posting the petitioners in various Sub Primary Health Centres within the same District-Chhindwara and it is now that they have been transferred from District-Chhindwara to District-Seoni. As this order of State Government is not in violation of the Statutory Provisions nor is any mala-fide made out in the matter, it is not appropriate for this Court to interfere into the matter, instead granting liberty to the petitioners to take recourse to the departmental remedies available, the petition is disposed of. With the aforesaid, petition stands disposed of.
