Judgment
Ajay Rastogi, J.—One of the contentions advanced by the counsel is that Petitioner is serving as Teacher and under the scheme of rationalization she was transferred vide order dt.20.06.2010 (Annx.1) to Government Girls Senior Secondary School, Bajaj Road, Sikar pursuant to which she joined and within short span of three months she has been further transferred from Bajaj Road to Ghod, Sikar vide order dt.30.09.2010 (Annx.3) only to accommodate Respondent-5 which cannot be said to be in the interest of administration. However, the appeal preferred has been dismissed by the learned Tribunal without examining the question which she raised in the for consideration.
Issue notice of writ & stay petition along with a copy of this order to the Respondents as to why the petition may not be disposed of at the stage of admission, returnable by four weeks. Notices may be given ''dasti, if desired. PF & notices be filed within seven days, failing which stay order shall stand vacated without reference to this Court.
In the meanwhile, operation of order dt.30.09.2010 (Annx.3) pertaining to transfer of Petitioner shall remain stayed and she may be allowed to continue to work in the institution where she was working prior to passing of order impugned dt.30.09.2010 (Annx.3), till further orders.
