Heard learned counsel for the parties.
The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 411,413,414,419,420,467,468,471,120(B)/ 34 IPC and Sections 66(B),66(C),66(D) of Information Technology Act.
Learned counsel for the petitioner submits that he has falsely been implicated in this case due to some confusion. He further submits that he is having no criminal antecedent whatsoever and for no offence he is lying in custody since 27.06.2023. He lastly submits that the charge sheet has already been submitted in this case and the co-accused of this case has already been granted bail by this Court in B.A. No. 8549 of 2023, as such he may be enlarged on bail.
Learned A.P.P. opposed the prayer for bail.
Having regard to the facts of the case and the nature of allegation alleged against this petitioner coupled with the fact that the charge sheet has been submitted in this case, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand Only) with two sureties of the like amount each out of which one bailor shall be mother of the petitioner to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Cyber Crime, Giridih, in connection with Ahilyapur, P.S. Case No. 38 of 2023. It is made clear that the petitioner shall appear on each and every date before the learned trial court during the trial, failing which learned trial court shall be at liberty to cancel the bail of the petitioner.
