Sony Singh @ Sonu-petitioner is seeking regular bail in the case bearing FIR No. 92 dated 01.05.2018 under Section 22 of Narcotic Drugs &
Psychotropic Substances Act. 1985 and under Section 379/411 of IPC, 1860, registered at Police Station Talwandi Sabo, District Bathinda.
Briefly, as per the allegations of the prosecution 500 tablets of Tramadol Hydrochloride have been recovered from the possession of the petitioner and
co-accused namely Balvir Singh @ Moto.
It has been stated by the learned counsel for the petitioner that he is in custody for the last about 02 years and 10 months and the similarly placed co-
accused, namely, Balvir Singh @ Moto has been granted bail by the Co-ordinate Bench of this Court in terms of order dated 03.12.2020 passed in
CRM-M-22163-2020 after he had undergone custody for a period of over two and a half years. It has been further stated that the petitioner is not
involved in any other case under NDPS Act and only one witness has been examined so far. Furthermore,copy of judgment dated 20.08.2019 passed
by Sub-Divisional Judicial Magistrate Talwandi Sabo indicates that Balvir Singh @ Moto was also co-accused with the petitioner in that case bearing
FIR No. 91 of 30.04.2018 under Sections 379 IPC registered at Police Station Talwandi Sabo.
On instructions from ASI Krishan Singh, learned State counsel has not disputed the aforesaid facts.
Keeping in view the fact that the petitioner is in custody for the last about 02 years and 10 months, similarly placed co-accused has been granted
regular bail, the conclusion of the trial is likely to take sometime and only one witness has been examined so far, sufficient grounds are made out to
extend the concession of bail to the petitioner.
Without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on bail on his
furnishing requisite bail bonds to the satisfaction of the learned trial Court/Duty Magistrate concerned.
The petition is allowed accordingly.
