Judgment
Accused No.4 in Crime No.184/2026 registered by Suryanagar Police Station, Bengaluru, for the offences punishable under Sections 140(2) and 351(2) of BNS, 2023 and Section 25 of the Indian Arms Act, 1959, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail.
Heard the learned counsel for the parties.
FIR in Crime No.184/2026 was registered by Suryanagar Police Station, Bengaluru, for the aforesaid offences against Praveen and unknown three others based on the first information dated 02.06.2026 received from Dayanand Reddy, S/o late B. N. Thimmareddy. In the said case, petitioner was arrested on 03.06.2026 and subsequently, remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5287/2026 was rejected on 22.06.2026. Therefore, he is before this Court.
In the first information dated 02.06.2026, the alleged victim has averred that, on 01.06.2026 at about 04.30 p.m., he had gone in his car bearing Reg.No.KA21/MC0006 along with his driver to Gold Coin Club and while he was returning from the club at about 12.15 hours on 02.06.2026, some persons who came in a motorbike, intercepted his car and asked his driver to get down from the car. Thereafter, one amongst them sat in the driver's seat and after threatening him with a gun, drove the car. Subsequently, a red-coloured car approached, in which the victim was kidnapped. The persons who came in the said car allegedly threatened him and informed him that they had supari for a sum of Rs.10 crores to commit his murder and they were all speaking in Malayalam language. He submits that one amongst the said persons was by name Praveen and it is under these circumstances, FIR was registered against Praveen and others for the aforesaid offences.
Remand application of the arrested accused would go to show that Praveen was known to the first informant even prior to the alleged date of incident. It appears that there was a road traffic accident on 08.11.2025 and for the purpose of repairing the car of the alleged victim in the present case, Praveen had issued a cheque to him which was dishonored. First informant has suppressed the said aspect in the complaint lodged by him before the police. Petitioner, who has no other criminal antecedents is in custody in the present case from 03.06.2026. Major portion of the investigation is already completed. It is not in dispute that petitioner has not been identified in the present case till date. Under the circumstances, I am of the opinion that his prayer for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:-
The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.184/2026 registered by Suryanagar Police Station, Bengaluru, for the offences punishable under Sections 140(2) and 351(2) of BNS, 2023 and Section 25 of the Indian Arms Act, 1959, subject to the following conditions:
Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
The petitioner shall not involve in similar offences in future;
