This writ petition has been filed seeking for a direction to the respondents to allot the vacant plot bearing L-76A in A.Jettihalli Dharmapuri, Hosur Housing unit to the petitioner on payment of the value already fixed by the respondents.

2.According to the petitioner, on 09.05.2013, he was allotted a flat bearing HIG(I) Flat No.16A (First Floor) at A.Jettihalli, Dharmapuri, by the Tamil Nadu Housing Board under a Hire Purchase Scheme, and a provisional allotment order was issued on 22.05.2013. Subsequently, it was informed to the petitioner that the allotment of flat scheme was scrapped and a new scheme has been framed for allotment of individual house plots vide notification dated 27.05.2018. The similarly aggrieved allottee one Poongodi filed a writ petition in W.P.No.7507 of 2018 and this Court, by order dated 20.12.2021, directed the respondents to consider the petitioner therein for allotment of the flat/plot in the new scheme or in the existing scheme. Therefore, the petitioner has given representation on 19.03.2025 seeking allotment of alternate vacant plot bearing L-76A in A Jettihalli Dharmapuri, Hosur Housing unit since the individual plots were sold out, but the same has not been considered. Hence, the petitioner has come up with the present writ petition.

3.Mr.A.M.Ravindranath Jayapal, learned Standing Counsel appearing for the respondents, on instructions, would submit that the upset price has already been fixed by the Housing Board. If the petitioner is willing to deposit the amount fixed by the Housing Board, the petitioner’s case will be considered. According to them, upset price has been fixed at Rs.3,64,20,000/- for the Community Hall No.L-76A, for an extent of 28167 sq.ft. in HOS 152.

4.Mr.M.S.Krishnan, learned Senior Counsel for Mr.J.B.Aadeish, learned counsel for the petitioner would submit that the petitioner is willing to deposit the said upset price fixed by the respondents.

5.In such view of the matter, though the respondents are now willing to execute the sale deed on deposit of the upset price, considering the fact that the amount is more than crores of rupees, this Court is inclined to give four months time to deposit the said amount.

Accordingly, the petitioner is directed to deposit the said amount within a period of four (4) months from the date of receipt of a copy of this order. On receipt of payment of the aforesaid upset price, the respondents shall execute the sale deed in his favour within a period of one month thereafter.

With the above directions, this writ petition is disposed of. No costs.
