Judgment
Having heard learned Counsel for the parties, we are satisfied that the delay in filing the present appeals has been sufficiently explained. The delay condonation applications are allowed. The appeals shall be treated to be within time.
We had heard the matter on previous occasions and after having gone through the pleadings, as is evident from the order dated 15th July, 2019 and the order dated 28th August, 2019, the learned Additional Advocate General had been called upon to inform the Court as to whether the appointment and the other reliefs, as claimed by the appellant stand conferred or not.
Shri Raza Ahmad has invited the attention of the Court to the document appended along with the reply captioned as "supplementary affidavit" dated 5th August, 2019 annexed as Annexure R/7 dated 14th August, 2018 which is extracted hereinunder:

सी0डब्लु0जे0सी0 संख्या-20170/16 उमेश मंडल बनाम राज्य सरकार एवं अन्य, सी0डब्लु0जे0सी0 संख्या-4855/17 मो0 अब्दुल करीम बनाम राज्य सरकार एवं अन्य, सी0डब्लु0जे0सी संख्या-12030/17 दिनेश कुमार सिंह बनाम राज्य सरकार एवं अन्य, में दिनांक-16.03.18 को पारित न्यायादेश में अररिया प्रमंडलान्तर्गत समायोजित कर्मियों के समायोजन की तिथि से ही याचिकाकत्र्तागण को समायोजित करते हुए और सेवा को निरंतर मानते हुए सभी आनुषांगिक लाभ देने संबंधी आदेश पारित किया गया है।
उक्त आदेश के अनुपालन हेतु याचिकाकत्र्तागण द्वारा एम0जे0सी0 संख्या-1738/18 उमेश मंडल बनाम राज्य सरकार एवं अन्य, एम0जे0सी0 संख्या-1871/18 मो0 अब्दुल करीम बनाम राज्य सरकार एवं अन्य, एम0जे0सी0 संख्या- 1856/18 दिनेश कुमार सिंह बनाम राज्य सरकार एवं अन्य दायर किया गया जिसमें दिनांक-08.08.18 को पारित न्यायादेश में यह कहा गया है कि दिनांक-16.03.2018 को पारित न्यायादेश का अनुपालन न होने की स्थिति में कार्यपालक अभियंता, लोक स्वास्थ्य प्रमंडल, अररिया पर अवमाननावाद की कार्रवाई संस्थित की जायेगी।
अतः अवमाननावाद की बाध्यकारी परिस्थिति के आलोक में इन कर्मियो को बिहारशरीफ प्रमंडलान्तर्गत वर्ष 2006 की रिक्तियों के विरूद्ध समायोजित करते हुए कार्यपालक अभियंता, लोक स्वास्थ्य प्रमंडल, अररिया के कार्यालय में पदस्थापित करने का निर्णय लिया जाता है। संबंधित कर्मी बिहारशरीफ के रिक्ति के विरूद्ध कार्यरत होंगे परन्तु उनके वेतन एवं अन्य आनुषांगिक लाभ का भुगतान अररिया के द्वारा ही किया जायेगा तथा उनका पदस्थापन अररिया प्रमंडलान्तर्गत होगा।
उपर्युक्त समायोजन एल0पी0ए0 संख्या-951/18, एल0पी0ए0 संख्या-952/18 एवं एल0पी0ए0 संख्या -953/18 में पारित आदेश के फलाफल से प्रभावित होगा।
इसे अन्य वादों के लिए पूर्वाेदाहरण नहीं माना जायेगा।
प्रारूप एवं प्रस्ताव पर विभागीय सचिव का अनुमोदन प्राप्त है।

On a perusal thereof, we find that after the writ petition had been allowed by the learned Single Judge a contempt petition was also filed for implementation of the said direction and, consequently, the respondent-petitioners Dinesh Kumar Singh, Md. Abdul Karim and Umesh Mandal came to be reinstated and as on date they are working. While passing the said order, it had been mentioned in paragraph 4 that this shall not be treated by the State Government as a precedent at its end.
Paragraph 5 of the said letter clearly recites that the proposal has the seal of approval of the competent authority, namely, the concerned departmental Secretary.
In view of the aforesaid reinstatement and the reliefs having been extended to all the three aforesaid persons, we confirm the said benefits having been extended under the order dated 14th August, 2019.
The appeal stands disposed off accordingly. We further set aside the order dated 24.9.2018 whereby the Government had stayed the operation of the said order. The interim order in this appeal dated 5.9.2018 stands dissolved.
