Mr. Nirav Padhiyar, learned advocate for the respondent submits that the respondent has expired on 19th September, 2022. He has placed on record the Death Certificate of the respondent – Jayantilal Magniram Joshi issued by Sub-Registrar, Birth & Death, Deesa Nagarpalika, Deesa, wherein it is mentioned that the respondent – Jayantilal Magniram Joshi has expired on 19th September, 2022.
In view of the statement made by Mr. Padhiyar, learned advocate for the respondent and Death Certificate produced on record, the present appeal stands abated.
