Heard learned counsel for the parties.
The present application, u/s 19 of the AT Act, 1985, has been filed by the applicant against the inaction of the respondents in not considering the applicant's representation dated 19.02.2016 and legal notice dated 06.03.2020 for grant of 3rd MACP. Sh. Yogesh Sharma, learned counsel for the applicant submits that the aforesaid representation and legal notice have not been considered and disposed of by the respondents till date.
Issue notice.
Shri Krishna Kant Sharma, learned counsel, who appears on advance service, accepts notice.
At this stage, learned counsel for the applicant submits that the applicant shall be satisfied, if the present OA is disposed of with direction to the respondents to consider the applicant's aforesaid representation dated 19.02.2016 along with the legal notice dated 06.03.2020 and to dispose of the same by passing a reasoned and speaking order in a time bound manner.
To such request of the learned counsel for the applicant, there is no objection from the learned counsel for the respondents.
In view of the aforesaid, without going into the merits of the case of the applicant, we dispose of the present OA with direction to the respondents to consider the applicant's aforesaid representation dated 19.02.2016 along with the legal notice dated 06.03.2020 issued on behalf of him and to dispose of the same by passing a reasoned and speaking order as expeditiously as possible and in any case, within 8 weeks of the receipt of the copy of this order.
OA is disposed of in the aforesaid terms. No order as costs.
