The petitioner Sucha Singh stands convicted under section 61(1)(c) of the Punjab Excise Act and he has been sentenced to undergo one year''s rigorous imprisonment and to pay a fine of Rs. 5000/. This revision filed by him was admitted only to consider the quantum of sentence.

The petitioner was apprehended on 5th July, 1984, when he was distilling illicit liquor. He is a young man of about 25 years and is a first offender. Having regard to his antecedents the sentence awarded to him is reduced to six months'' rigorous imprisonment and a fine of Rs. 2000/ in default of payment of which he will undergo further rigorous imprisonment for three months.

With this modification in the order of sentence the revision is dismissed on merits.
