S.J. Mukhopadhaya, J.—In pursuance of Court''s order. Mr. P.K. Sinha, Electrical Executive Engineer, Electric Supply Division, Urban-I, Ranchi is present and has also filed a show cause. He has taken plea that he is posted against the post in recent past on 13th Sep- tember, 2001. Further it is pleaded that the petitioner was not under the Control of the Electrical Executive Engineer and, as such, there was no occasion for the erstwhile Electrical Executive Engineer to look into the matter.

Mr. Sinha however, stated that the matter has now been settled and handed over two cheques of the State Bank of India, both dated 8th January, 2002, towards the retiral benefits and other dues of the petitioner. Cheque No. 1482317 dated 8th January. 2002 is for a sum or Rs. 89,036.77 paise has been issued towards the arrears of gratuity and Cheque No. 482320 dated 8th January. 2002, for a sum of Rs. 88,408.00 has been issued towards the arrears of pension. Both the cheques are being handed over to Miss. Malabika Ghosh, counsel for the petitioner, for onward transmission to the petitioner.

Counsel for the petitioner submits that the interest at the rate of 8% for delayed payment has not been paid as was earlier ordered by this Court.

Having regard to the facts and circumstances, this Court is not inclined to proceed further. If the interest as per the Court''s order has not been calculated and paid, the Electrical Executive Engineer, Electric Supply Division. Urban-I, Ranchi, will look into the matter and ensure payment, preferably within two months from the date of receipt/production of a copy of this order.

The contempt proceeding is accordingly, dropped and the present M.J.C. stands disposed of. Appearance of Mr. K.K. Sinha, Electrical Executive Engineer, Electric Supply Division, Urban-I, Ranchi, is hereby dispensed with.
