We have joined this Division Bench online through video conferencing.
Shri L.S. Kushwaha holding brief of Shri Bhagirathi Tiwari, learned counsel for the applicant is present in court. Shri R. K. Srivastava, learned
counsel for the respondents is present online.
M.A. No.330/510/2021 is a withdrawal application, filed by the applicant, in instant O.A.No.330/941/2013.
Heard learned counsel for the parties.
Learned counsel for the applicant has submitted that the applicant may be permitted to withdraw this O.A.No.330/941/2013 as well as
C.P.No.330/163/2013 with liberty to file a fresh O.A.
Learned counsel for the respondents has no objection against the aforesaid prayer.
In view of the above, MA No.330/510/2021 is allowed. O.A. No.330/941/2013 is dismissed as withdrawn. However, the applicant is at liberty to file
the fresh O.A. if, cause of action survives.
All the MAs pending in this OA are dismissed as infructuous.
