Judgment
Heard.
Mr. K.S. Rajpurohit, AAG has submitted that the District Administration, Jodhpur through the Municipal Corporations (North & South) respectively is
providing food packets in the camps where the Pakistani Minority Migrants are residing. It is informed that yesterday 200 food packets were
distributed in those camps. It is further informed that as per their estimate around 25,000 Pakistani Minority Migrants are at present residing in State of
Rajasthan in various Districts including around 7,500 in Jodhpur. It is submitted that every Pakistani Minority Migrant is not in need of free ration and
food because many of the families are self-sufficient. It is further submitted that the District Administrations are taking note of the situation and will
ensure that no such person will be deprived from ration or food during the period of lock-down.
So far as the COVID-19 vaccination of the Pakistani Minority Migrants is concerned, it is submitted that the SOP dated 6.5.2021 issued by the
Central Government is silent regarding the Pakistani Minority Migrants and, therefore, clarifications are being sought from the Central Government
regarding the vaccination of Pakistani Minority Migrants, who have not been granted citizenship till date.
We are of the opinion that the SOP on COVID-19 vaccination of persons without prescribed identity cards through CoWIN issued by the Central
Government is elaborate and in no way excluding the Pakistani Minority Migrants who are eligible for COVID-19 vaccination. We have also noticed
that several directions regarding identification of group of people including in the SOP have been given, but the State has not submitted any details
regarding the identification of such groups.
Mr. K.S. Rajpurohit, AAG seeks some time to furnish details regarding the steps taken by the State in every District as per the procedure given in
Clause 5 of the SOP.
Mr. Mukesh Rajpurohit, ASG and Mr. Vipul Singhvi, ASG, counsel for the Central Government have filed an affidavit of the Under Secretary,
Ministry of Health and Family Welfare, Government of India, New Delhi wherein, it is stated that the Central Government has already issued a
detailed SOP on COVID-19 vaccination of the persons without prescribed identity cards through CoWIN on 6.5.2021 and after receiving the requisite
information from the State and District Administration regarding the groups included in the above SOP, the vaccines will be provided to them.
In view of the above submissions, we deem it appropriate to list this matter on 3.6.2021 at 9 AM.
On that day, Mr. K.S. Rajpurohit, AAG shall submit a detailed report regarding compliance of the guidelines given in Clause 5 of SOP dated 6.5.2021
in the State of Rajasthan.
In the meantime, we deem it appropriate to direct the State Government to ensure that Ration material/Food packets be made available to all the
needy Pakistani Minority Migrants residing in various districts of Rajasthan either through the Food Supplies Department/Local Bodies or
NGOs/Social Institutions.
