Judgment

The only grievance of the petitioners is that they are BPL card holders, therefore, are entitled for the allotment of the plots under the scheme floated by the Government of Haryana, however, their names were not included in the final list prepared by the Deputy Commissioner, Rewari for the allotment of plots.
Learned counsel for the petitioners, while referring to Annexure P-4 to P-6, has vehemently argued that on the earlier occasions also, on different petitions, this Court has directed Deputy Commissioner to consider the claims of the petitioners for the allotment of land under the policy. Learned counsel has further argued that petitioners have already given representation (Annexure P-2) and legal notice (Annexure P-3), however, no action has been taken by the respondents thereon. He further submits that respondents should have taken decision on the representation as well as on legal notice (Annexures P-2 and P-3) in the light of directions issued by this Court in three different petitions (Annexures P-4 to P-6).

On being asked, Mr. Deepak Girhotra, learned Assistant Advocate General, Haryana, has accepted notice on behalf of the respondents.
Mr. Girhotra has fairly stated that decision shall be taken on Annexures P-2 and P-3 in accordance with law, however, he states that it should be left open for the respondents to find out as to whether petitioners are eligible for the allotment of the land as per the Government scheme.
Without expressing any opinion on the merit of the case, present petition is disposed of with the direction to respondents to take decision on Annexures P-2 and P-3 within 90 days from today.
