The instant petition has been filed for grant of the following substantive relief(s):

“(i) That writ in nature of mandamous may very kindly be issued directing respondent No.1 to 3 to initiate appropriate legal proceedings or initiating against the i.e. respondents No.4 to 6 who have caused the said loss of the Govt. Property, damages and cutting the said deodar trees standing upon the Govt. land and kindly passed the order initiate and appropriate action against the respondent No.2 to 3 and respondent No.4 to 6 in order to meet with the ends of justice.

(ii) That the directed to the respondent No.1 to 3 to prepare the damage report of the said Deodar Trees and further directed to produce the damages of trees, challan before the concerned competent authority immediately and entire record pertaining to this case may kindly be summoned for the kind perusal .

(iii) That respondent No.2 & 3 may be directed to file/put the damage challan/detailed challan of the said cut deodar tree upon the Govt. land over the said Khasra No.699 and other khasra No./due to the damage of the forest produced before the competent court of law within 3 weeks immediately.”

The officials respondents No.1 to 3 have filed their reply which goes to indicate that appropriate action has been taken against the private respondents for illegal construction of the road over the forest land, by not only chalking out damage report No.40 dated 26.7.2017, but even FIR No.82/2018 also stands registered with the Police Station, on 9.5.2018.

In such circumstances, the petition has achieved its purpose and is disposed of accordingly. However, in case, the petitioner is still aggrieved, he is at liberty to avail the remedy, as available to him under the law, including revival of the instant petition.
